This Refund and Cancellation Policy ("Policy") applies to all services provided by FAIRMOUNT HOTELS PRIVATE LIMITED, trading as "Fairplay" ("Company," "we," "our," or "us"). This policy outlines the terms and conditions under which refunds and cancellations are processed for our IT services.

By engaging our services, you acknowledge that you have read, understood, and agree to be bound by this Policy.

2. General Refund Principles

We are committed to providing high-quality IT services and ensuring customer satisfaction. However, due to the nature of our services, refunds are subject to specific terms and conditions outlined below.

All refund requests must be submitted in writing to contact@fairtexfashion.shop within the specified timeframes and must include detailed reasons for the refund request.

3. Service-Specific Refund Terms

3.1 Web Development & Application Development

Refund Eligibility:

  • Before Project Commencement: 100% refund if cancellation is requested before work begins
  • Within 7 Days of Project Start: 80% refund if less than 25% of work is completed
  • Within 14 Days of Project Start: 50% refund if less than 50% of work is completed
  • After 14 Days: No refund, but project can be transferred to another developer

3.2 Cloud & DevOps Services

Refund Eligibility:

  • Monthly Services: Prorated refund for unused portion of the month
  • Annual Services: Prorated refund minus 20% administrative fee
  • Setup Fees: Non-refundable after service activation
  • Data Migration: Non-refundable once migration begins

3.3 Security & Compliance Services

Refund Eligibility:

  • Security Audits: 100% refund if cancelled before audit begins
  • Ongoing Security Services: Prorated refund for unused service period
  • Compliance Consulting: 50% refund if cancelled within 48 hours of engagement

3.4 Managed IT Support

Refund Eligibility:

  • Monthly Support: Prorated refund for unused days
  • Annual Support: Prorated refund minus 15% administrative fee
  • Emergency Support: Non-refundable once service is provided

4. Non-Refundable Services

The following services and charges are non-refundable:

  • Custom software development after 50% completion
  • Third-party software licenses and subscriptions
  • Domain registration and hosting fees
  • SSL certificates and security tools
  • Data backup and recovery services already performed
  • Training sessions already conducted
  • Consulting services already provided
  • Emergency support services

5. Refund Process

5.1 How to Request a Refund

To request a refund, please follow these steps:

  1. Send an email to contact@fairtexfashion.shop with the subject "Refund Request"
  2. Include your project/service details and invoice number
  3. Provide a detailed reason for the refund request
  4. Attach any relevant documentation or evidence

5.2 Refund Processing Timeline

  • Refund Request Review: 3-5 business days
  • Refund Processing: 5-10 business days after approval
  • Bank Transfer Refunds: 7-14 business days
  • Credit Card Refunds: 3-7 business days

5.3 Refund Methods

Refunds will be processed using the same payment method used for the original transaction. If the original payment method is no longer available, we will work with you to find an alternative method.

6. Cancellation Policy

6.1 Service Cancellation

You may cancel our services at any time by providing written notice. The cancellation will be effective at the end of the current billing period, unless otherwise specified in your service agreement.

6.2 Project Cancellation

For ongoing projects, cancellation requests must be submitted in writing. The refund amount will be calculated based on the work completed and the terms outlined in section 3.

6.3 Data Retrieval

Upon cancellation, you have 30 days to retrieve your data and files. After this period, we may delete your data in accordance with our data retention policy.

7. Dispute Resolution

If you are not satisfied with our refund decision, you may:

  1. Request a review by our management team
  2. Provide additional documentation to support your case
  3. Request mediation through a neutral third party
  4. Pursue legal action in accordance with our Terms and Conditions

We are committed to resolving disputes fairly and amicably.

8. Special Circumstances

8.1 Force Majeure

In cases of force majeure events (natural disasters, government actions, etc.), we will work with you to find appropriate solutions, which may include service credits or extended deadlines rather than refunds.

8.2 Service Quality Issues

If you experience service quality issues, we will first attempt to resolve the problem. If resolution is not possible, we will consider refunds on a case-by-case basis.

8.3 Client Default

If a project is delayed or cancelled due to client default (non-payment, non-cooperation, etc.), no refund will be provided for work already completed.

9. Refund Exceptions

We reserve the right to deny refunds in the following circumstances:

  • Services have been fully delivered as per the agreement
  • Client has violated the terms of service
  • Refund request is made beyond the specified timeframes
  • Client has already received multiple refunds for similar issues
  • Refund request is based on false or misleading information
